- Formula: total basic salary actually earned from January to December ÷ 12 (Presidential Decree 851). Overtime, night differential, holiday pay and allowances are not part of basic salary unless your company says otherwise.
- Prorated: if you joined, resigned or took unpaid leave, only the basic salary you actually earned counts. Rank-and-file employees who worked at least one month are covered.
- Due date: on or before December 24. Some employers pay half in May or June and half in December.
- Tax: the 13th month pay and other benefits are tax-free up to ₱90,000 in total for the year (TRAIN law). Anything above is added to your taxable income.
- Resigned employees: you still get the prorated amount, usually with your final pay.
